Are you familiar with Fireball Cinnamon Whisky? If you are, then we can assume that you know about Fireball Cinnamon as well. Sazerac Company manufactures both drinks, however, this January, a lawsuit has been filed against them. The Fireball Cinnamon has this deceptive information on its label, and the plaintiff may have just caught that. From Cook County, Illinois, the plaintiff filed a case against Sazerac company, so find out more about the explained Fireball Cinnamon Whisky lawsuit below.
Lawsuit against Fireball Cinnamon manufacturer
Sazerac’s original Fireball Cinnamon Whisky is significantly whisky-based. As their tagline goes “Taste like Heaven, Burns like Hell”, you’ll expect that it’s some kind of liquor.
- Their other product though, the Fireball Cinnamon, differs from Fireball Cinnamon Whisky. The 99 cents won’t bottles that sold almost everywhere do not have the whisky kick, and if you ever thought it has, we’re sorry to say that it’s whisky-free.
- Plaintiff Anna Marquez from Illinois filed a lawsuit against Sazerac Company about the resemblance of both products (which is true). The packaging of the Fireball Cinnamon may have been tweaked a little, but not so much when you don’t get into its details.
- According to the suit via NBC Chicago, “The bottles appear identical but for the word ‘Whisky’ on the front label, which most purchasers seeking alcohol will not even detect.”
- The wrong choices of words on the Fireball Cinnamon label added fuel to this fire. It writes “Malt Beverage With Natural Whisky & Other Flavors and Caramel Color,” if you read it again, you’d probably think that it has Natural Whisky. But, it doesn’t — the label do means that it comes with a Natural Whisky FLAVOR and other flavors. Confusing, right?
- According to the lawsuit, the company violated the Consumer Fraud and Deceptive Business Practices Act, State Consumer Fraud Acts, and Breaches of Express Warranty.
Sazerac Company’s response
As of this writing, everyone awaits Sazerac’s response. In a report from NBC Chicago, the team tried to reach out to the manufacturing company, however, they received nothing. Sazerac Company told them that they do not comment on this “ongoing litigation”.
More about the Fireball products
While Fireball currently is under fire, let’s take a look at the difference between the two products. When you both see the products on the market, you won’t notice many differences though, but the label says a lot.
- Fireball Cinnamon, repetitively, does not contain whisky. This product has been made to grant the fans “who want a wider variety of convenient shopping locations” as it can be sold in beer, according to the website. On the other hand, Fireball Whisky can still be purchased in bars, restaurants, and liquor stores.
- Furthermore, check the label and see if there’s a Whisky. If there is, then it should be Fireball Whisky, the whisky-based liquor. If it only writes Fireball Cinnamon, then that’s their malt-based or wine-based product.
- Fireball Cinnamon products include malt-based and wine-based alcoholic beverages, whereas Fireball Whisky is whisky-based. So if you’re planning to purchase the whisky-based, head to the liquor stores and find it there. But if you choose the lighter Fireball, then you may head to gas stations and other convenient shopping places.
